MERCY MUSLIM CEMETERY Regulations
For the mutual protection for itself and every plot, the following
are hereby adopted as the rules and regulations of the Mercy Muslim
Cemetery, hereby referred as M.M.C.
All visitors within the cemetery and all plots shall be subjected
to said rules and regulations, and subject further to such other
rules and regulations, amendments or alterations as shall be adopted
by M.M.C. from time to time; and the reference to these rules and
regulations in the right of interment certificates shall have the
same force and effect as if set forth in full therein. These rules
and regulations are filed with the courthouse of Logan County, in
the State of Oklahoma, and are permanent part of their records.
This project was made possible by the Mercy of Allah and the generous
donations of the Muslims of Oklahoma City Metro area including the
Islamic Societies of Greater Oklahoma City, Norman, and Edmond.
REGULATIONS
- The M.M.C. is ONLY FOR MUSLIMS, therefore all others are not
granted space in the M.M.C.
- The M.M.C. reserves the right to refuse any request for burial
without providing any reasons.
- All funerals upon arrival at M.M.C. shall be under the supervision
of the sexton (Person in charge of the cemetery).
- M.M.C. will not allow the body of any deceased to be buried
without all that is required by law (see attached graphs for details):
- 1. If the deceased is from the State of Oklahoma, a Death
certificate filled and signed.
- 2. If the deceased is from outside the State of Oklahoma,
a Death certificate filled and signed along with a Burial-transit
permit.
- The sexton of the cemetery has three duties:
- First is the verification of the Identification and paperwork,
- Second the sexton signs the death certificate, then the
sexton shall keep a copy as part of the permanent records.
- Third coordinates all funeral arrangements.
- Once the remains have been accepted, they must be interred within
24 hours.
- M.M.C. reserves the right to refuse any ritual that has no ground
in the Islamic Shariah jurisprudence before, during, and
after burial.
- M.M.C. reserves the right to refuse permission to anyone to
open the coffin or to touch the body of the deceased without the
consent of the legal representative of the deceased or without
a court order.
- The Sexton will arrange for body viewing at Funeral facility
ONLY, when requested.
- There will be NO body viewing in the mosque.
- Burial in M.M.C. follows the phase sequence adopted by the Logan
County, State of Oklahoma.
- Monuments shall not be permitted on graves or plots in any section
within the cemetery. Only markers, size as specified by M.M.C.
shall be allowed, and they must be set level with the ground at
the head of each grave space. Only one marker per grave space
shall be allowed, as per Logan County rules and regulations.
- Grave depth shall be a minimum of six (6) feet below the surface
of the ground.
- All graves shall be flush with the surface of the ground.
- No gravesite shall be located within 25 feet of the property
line, within 100 feet of a channel of any drainage way identified
on a survey filed with the Logan County.
- No graves or structures shall be located within any utility
easements on the property. See survey for details.
- M.M.C. disclaims all responsibility for loss or damage beyond
its control, and especially from damages caused by elements, act
of God, common enemy, thieves, vandals, strikers, malicious mischief
makers, explosions, unavoidable accidents, invasions, insurrections,
riots or order of military or civil authority, whether damage
is direct or collateral.
- M.M.C. reserves the right to regulate the method of decorating
graves to harmonize with surroundings.
- No additional plants are allowed.
- Special cases may arise in which the literal enforcement of
a rule may impose unnecessary hardships. M.M.C. therefore reserves
the right, without notice, to make exceptions, suspensions or
modifications in anyone or all of the rules and regulations when
in its judgment such charges appear advisable. Such temporary
exceptions, suspension or modifications shall in no way be construed
as affecting the general application of these rules and regulations.
- M.M.C. shall not be held responsible for any information given
by telephone or for any mistake occurring for want of precise
or proper instructions.
- M.M.C. reserves the right to enlarge, reduce, re-plat or change
the boundaries of cemetery property, including the right to modify
or change the location of, remove or re-grade roads, drives, walks,
parkways, or any part thereof.
- M.M.C. reserves to itself and to those lawfully entitled thereto,
a perpetual right of access over any plot for the purpose of passage
to and from other plots.
- M.M.C. reserves the right to require written application by
the plot user to open any burial space.
- M.M.C. may adopt new rules and regulations from time to time
or it may alter, amend or repeal all or any part of these rules
and regulations. At such time these rules and regulations shall
be amended or replaced by the new rules and regulations.
- M.M.C. had signed a contract with Hahn-Cook, Street & Draper
Funeral Services, located at 6006 N. Grand Blvd., Oklahoma City,
OK 73118 (405-848-3744), and will utilize their services for all
burials.
Following is a sequence of steps for all burials:
- Hahn-Cook, Street & Draper Funeral Services will pick up
anywhere in the Metro area.
- A washing committee will go to prepare the body.
- The body will then be brought to Masjid An-Nasr for prayer.
Additional charges will apply if taken to another mosque.
- Hahn-Cook, Street & Draper Funeral Services will then transport
the body to M.M.C. for burial.
- M.M.C. had signed a contract with Wilbert Graveyard Services,
located at 345 W. Hefner, Oklahoma City, OK 73114, (405-752-9033),
for digging and closing graves and installing head stones.
- M.M.C. Sexton will arrange for grave digging and closing by
calling Wilbert Graveyard Services.
- A head marker will be ordered by M.M.C. Please provide the first
and last name of the deceased along with the date of birth and
date of death for the head stone.
- Once on M.M.C. property, please obey all signs.
- Please park at the designated areas only.
- Please refer to the Charges and Costs Schedule on the next page.
- According to Islamic Law, any Muslim who cannot afford any or
all charges will still be buried in M.M.C. for absolutely NO CHARGE.
Islamic Society of Greater Oklahoma Citys Zakat Fund will
be used to cover the expenses.
- Please note, however, also, according to Islamic Law, funeral
expenses must be paid by the deceaseds wealth or his/her
relatives wealth.
- Other arrangements such as the use of chapel at Hahn-Cook, Street
& Draper, police escort, and pick up outside Oklahoma City
Metro area will cost extra.
